As you may know I was able to talk to David Gooder,
the USPTO Commissioner as well as key training staff
members Jason Lott and Craig Morris over the last 4
months, as part of our never ending quest to go back to
the year 2010. That is when everyone – trademark
services like us and trademark attorneys directly –
actually did true comprehensive legal research BEFORE ever filing ANY trademark
application. Then the “trademark mills” started operations and took over the top of the
Internet. To reach a rock bottom price, they negligently file mark after mark with very little
or no legal research to determine IF a mark is LEGALLY CLEAR – or not, before use,

An attorney’s duty is to watch out for their clients, and advise properly, to convey the very

One more thing I learned in my conversations with the USPTO, is that bystatute the
USPTO can only research it’s own database of 3.5 million Federal trademarks. I had never
heard that before, that they were constrained by statute. I knew they didn’t research State
trademarks, (1.5 million marks) or common law right holders, (25 million marks.
What is trademark infringement?
Trademark infringement is the unauthorized use of a trademark’s sameor related goods or
services in SOUND, APPEARANCE or MEANING, while also considering customer type
and distribution channels, as well, in a manner that is likely to cause confusion in the
marketplace. Acquiescence happens when a mark is not enforced over time, thereby
