Trademark Search Analysis Included

Importance of Common Law Research: This research is crucial before using your trade name or expanding its geographic area, and the USPTO recommends that it be done before applying for a State or Federal trademark. Even if you own the trademark for your business name, it’s essential to conduct common law research. This is because you could still be infringing on another business’s rights, especially if they have used the name first.

Sources We Use: We use Thomson Reuters Westlaw, which is an “industry leader for legal research platforms and tools.” Our comprehensive Common Law search looks at –

Step 4: $300 USPTO Federal Trademark Application (after $100 Discount)

Once your searches are clear or you decide to move forward after consulting the attorney, it’s time for the trademark application.

When you got your order confirmation email, you also got an application worksheet. Fill it out completely. We’ll use this to prepare your trademark application and guide you through the USPTO Manual for pre-approved descriptions of goods or services. After you send us the completed worksheet, we’ll prepare your US Federal trademark application and help you submit it. This usually takes 2-3 days.

Just a reminder:

The filing fees for State or Federal USPTO trademarks are separate. When you file the prepared application we deliver to you via email, you’ll need to pay the filing fee. For Federal applications, it’s $350 per class. State fees vary by State.

Other trademark search companies bundle the Trademark and Common Law searches without providing any analysis. This means that if your trade name is blocked early in the Trademark search, you’ll still be charged for the entire Common Law search.

This is a perfect package for when you have done your comprehensive legal research elsewhere. We offer free analysis of your prior legal research report, to double-check if it was analyzed correctly and if in fact it is comprehensive. Comprehensive research reports should be in the hundreds of pages. (Ours are usually 600-800 pages.) Hard to miss. Our free review includes trademark attorney review as well.

We never, nor should anyone ever, recommend applying for a trademark without the clearance of a comprehensive trademark search beforehand to prove the name, slogan or logo mark is legally clear BEFORE first use, BEFORE applying for a trademark. The reason is trademark law is much broader in sound, appearance and meaning than you realize. Related goods/services affect you. Channel of distribution, customers as well. Famous names too. A web search or direct hit preliminary search is NOT enough. Although recommended, a light search is NOT a stopping point. It is a beginning.

By statute, the USPTO and CIPO will only research their own databases – never researching State trademarks or common law databases – which make up 88% of what may legally block you. This is why review by a trademark attorney is such a critical need. IF your new mark is infringing on another company’s first use rights under common law, they will have 10 years to find and cease and desist your mark. If they have a prior trademark the USPTO will refuse your application in 8 months. If in Canada, it could take 2 years to be refused.

How It Works

Forward your prior attorney performed trademark research report to us for a free analysis. Let’s make sure the basis of your intended new trademark proves you new name, slogan or logo is LEGALLY CLEAR, under trademark law first.

TradeMark Express will email you a quick worksheet for you to complete so we may write your trademark application, including a professional representation of your goods or services associated with your trademark. Once received, we will then prepare and submit your Federal trademark application. Please allow 2-3 days service time.

Intent to Use

If you filed as a USPTO Intent-to-Use

The USPTO will send Intent-to-Use applicants a Notice of Allowance, which essentially is your notice that the USPTO is waiting to hear from you if the mark is actively in use. You have 6 months from the date the Notice of Allowance was sent to respond. Failure to do so will result in the cancellation of the trademark.

If you know you will not be in commerce within 6 months of your Notice of Allowance, then it is recommended that an Extension of Use be filed, which is $125 per class. One extension gives applicants an additional 6 months to file the Statement of Use. The USPTO grants 5 extensions, with some exceptions.

If you filed as an USPTO Intent-to-Use and are not ready to use the name

You need to be aware that there are additional forms necessary for keeping your Federal trademark active.

There are four applications that TradeMark Express will prepare and file for you.

Once the name is actively in use in commerce (i.e. across state lines or between the US & any other country), the USPTO needs to be notified via a Statement of Use/Amendment to Allege Use form, a $100 per class and a specimen of use.

Failure to file this form will result in the cancellation of the trademark.

TradeMark Express will prepare and file this form for $150.

Our trademark application preparation and filing does not include step-by-step comprehensive research. We will analyze other firm’s research to make sure it is comprehensive before filing. State or Federal USPTO trademark filing fees vary and are not included in the application preparation service. Your filing fee is due when we electronically file your State (filing fees range widely, per State) or Federal USPTO trademark application — $350 per class. Filing fees are separate from TradeMark Express’ service fees.
