Intent to Use

What to Do If Your Trademark Isn't Yet in Use
If your business isn’t up and running yet, you can still apply for a Federal trademark using an Intent to Use (ITU) filing. This allows you to secure your trademark before launch, even if your goods or services aren’t ready. Additional forms are needed to obtain trademark registration.
Once your trademark is actively in business:
File either an Amendment to Allege Use (before your mark is approved for publication) OR a Statement of Use (within six months of receiving the Notice of Allowance). Fees for these forms are $100 per class, plus at least one specimen per class.
If you won’t be using your trademark in time:
Extension Requests: File within six months of receiving the NOA, with a fee and a statement of your intention to use your mark. You can file up to four additional requests, each for a six-month period, showing ongoing efforts to use your mark. You must file a Statement of Use (SOU) within three years (36 months) from the date the NOA is issued. Each six-month extension costs $125 per class.

Failure to file promptly will result in trademark abandonment.
