Hello Everyone, thank you Hemant for the lead that led me to web site THE DAILY SCAM.
Double checking the phone number (848) 999-5102, (as I have learned is a useful clue), from Hemant’s July 2024 complaint about the Matrix Intellectual Property Office @ matrixipo [com] and Paragon Trademark @ paragontrademark [com].
The web sites are now long dead, like I see the pattern over and over.
My Google search gave me a hit on THE DAILY SCAM newsletter.
Turns out the World is full of all kinds
of scams, not just trademark scams.
Who knew?! Not THIS MANY scams.
Seriously. I don’t get out much… Too sad…seriously.

Unlike other societal gatekeepers we have in play, my email overture to THE DAILY SCAM received a reply. An actual phone call, not an idiotic couched endless 2020’s email exchange.
What a fun conversation I had with Doug, one of the owners. I learned a few things and gained a few tools to continue my endless quest vs the trademark scammers. Doug liked TradeMark Express enough to warrant an inclusion on a January 8 article update. Please see pages 12 to 14 of the 22 page well detailed article.
Doug was so impressed with my work, I was offered a job at 10x their usual pay. In other words, “nothing”. Would I consider a lateral move, post TradeMark Depress? Stay tuned!
Here’s the email offer Hemant received,
that caused him to wince, (you should too):
“This is Brian Collins, IP Attorney at Paragon Trademark. We would like to inform you that we have received a trademark application for a business name identical to yours xxxxx xxxxx. Should this application proceed, and the applicant secures federal ownership and protection for the trademark, you would be required to cease all usage of this name in accordance with the Patent & Custom Law and the United States Trademark Law.”
“The application is currently being processed with the United States Patent & Trademark Office for trademark registration. During our research in the IP databases, your information was identified. According to USPTO and intellectual property protocols, priority is generally given to the original user of the business name/mark over a new applicant. Thus, we are reaching out to ascertain your interest in securing federal trademark rights for your business name.”
“If you do not wish to register the trademark, we will proceed with the federal registration for the other applicant, as trademarks are awarded on a first-come, first-served basis rather than first use.”
“We kindly request your prompt response, as the other applicant’s registration process is currently on hold pending your decision. If we do not hear from you within the next two business days, we will proceed with the registration for the other applicant according to the standard examination and filing procedures of the USPTO.”
“As stipulated by the Lanham Act (Act of 1946, §§ 1051 et seq.), federal registration is mandatory to secure ownership rights.”

A general USPTO search found 2 trademark attorney filings by a Brian Collins. One in 1999 and another in 2000. Both trademarks are long dead. For perspective the USPTO received 12.1 million trademark applications between January 1870 and February 2023. See for yourself @ uspto.gov:

Who would dream of, strive and accomplish being a real bar certified attorney to risk all that to associate themselves with these knuckle dragger caveman scammers?
The attorneys are often contrived, or identities are stolen, be it deceased, retired or even still practicing. I have interviewed people at the USPTO about this unnatural phenomenon. Please see prior articles.
The attorneys I have tracked down and talked to me are flabbergasted their names are being usurped. They are obviously not associated with the scammers. Their practice areas are completely opposite to intellectual property law. One attorney said he called the California Bar to report his own name, because he wanted them to know he had no association whatsoever with the scammers. As he put it, “I called the Bar to report myself”.
